[국세청 제공]국세청이 법인 명의 고가주택을 사주 일가의 사적 공간으로 사용하거나 법인자금을 유출한 이른바 ‘황제사택’ 업체 50곳에 대해 세무조사에 착수했다.조사 대상에는 대기업 5곳과 상장사 6곳(코스피 4곳·코스닥 2곳)이 포함됐으며, 국세청은 이들 업체에서 총 1조9000억원대 탈루 혐의를 포착했다.유형별로는 사주 일가가 거주하는 ‘사주일가 거주형’이 28곳으로 가장 많았다. 서울 강남3구와 마포·용산·성동구 등 이른바 ‘마용성’의 고가주택을 법인 명의로 취득해 사주 가족에게 제공한 사례다.음식·숙박업을 하는 A법인은 서울 용산구 한남동 소재 200억원대 고급주택을 취득하고, 100억원대 증축비와 인테리어공사비를 댔다. 이미 인근에 300억원대의 다른 주택을 보유하고 있었지만 이 주택에 거주하려는 사주일가를 위해서였다.인건비 형식으로 약 200억원의 법인자금도 사주일가에게 부당하게 유출한 것으로 파악됐다. 특히 사주에게는 동종업계 최고 급여 수령자 평균 대비 10배에 달하는 급여를 지급한 것으로 파악됐다.B법인은 서울 강남구 청담동의 40억원대 빌라를 사주 일가의 사택으로 제공하고, 해외 유학 중인 사주 자녀의 고급 레지던스 임차료와 체류비를 지원했다. 사주 배우자에게 허위 인건비를 지급하는 방식 등 법인자금 약 30억원을 유출한 것으로 조사됐다.C법인은 부산에 본사를 두고도 서울에서 근무하는 사주 자녀를 위해 서초구 반포동의 40억원대 아파트를 취득해 제공했다. 사주가 운영하는 개인사업과 관련해 필요하지 않은 부동산을 빌린 뒤 고액의 허위 임차료를 지급해 주주인 자녀들에게 이익을 나눈 혐의도 받고 있다.‘별장형’ 기업도 17곳이 있었다. 직원의 복지를 명목으로 휴양지의 고가 콘도·별장을 사들인 뒤 ‘회장님 전용’으로 사용하는 형태다. E법인은 계열사를 이용해 100억원대 초호화 별장을 취득한 뒤 출입을 철저히 차단해 사주일가 전용으로 썼다.외국계인 F법인은 1박에 300만원에 달하는 60억원 상당의 고급 단독주택형 콘도를 사주일가 전용 별장으로 사용하고, 사주 아파트의 20억원대 인테리어 비용을 법인에서 대납했다. 또 사주 동생이 지배하는 관계사에 수수료를 지급하고 사주 누나에게 급여를 주는 방식으로 약 60억원의 법인자금을 유출한 혐의가 포착됐다.법인 명의 고가주택을 이용해 사주 일가가 다주택자 규제나 대출 규제를 피하도록 한 ‘부동산 투기형’ 기업도 5곳 이었다.도소매업체인 H법인 사주는 서울 서초구 반포동 재건축 예정 아파트를 관리처분계획인가 직전에 취득해 1세대 2주택자가 됐다. 재건축에 따른 이익 수십억원이 기대되는 곳이었다. 그러나 이 사주는 기존에 보유하던 40억원대 고가주택을 H법인에 넘겨 1세대 1주택 비과세 혜택을 누리고, 매도한 주택에 무상으로 계속 거주한 것으로 조사됐다.이 밖에 공시가격 합계 약 200억 원에 달하는 고가주택 2채 중 1채를 법인 명의로 취득한 뒤 사주가 하나의 주거공간으로 사용하면서 종부세 부담을 줄인 사례, 법인이 사업자 대출을 일으켜 사주 자녀가 30억 원대 단독주택을 구입할 수 있도록 법인자금을 지원하고 인테리어 비용까지 대납해준 사례도 확인됐다고 국세청은 설명했다.국세청은 일시보관, 계좌조회, 포렌식 등 가용 수단을 총동원해 조사를 진행할 방침이다. 법인자금을 부당하게 유출해 사적 이익을 취한 사주 등에 대해서는 세금을 추징하고, 조세포탈이나 거짓 세금계산서 수수 등 조세범칙 행위가 확인되면 형사처벌을 받도록 조치할 계획이다.국세청은 고가 법인주택 2639채를 전수검증한 뒤 사적 사용이 확인된 1097채(약 42%)를 소유한 법인의 신고내용을 추가 분석해 이번 조사 대상을 추렸다.이성글 국세청 조사국장은 “이번 조사대상에 포함되지 않은 전수검증 대상 법인도 분석 중”이라며 “탈루혐의가 중대한 법인은 순차적으로 세무조사할 예정”이라고 밝혔다.이어 “국내 황제사택뿐 아니라 회장 유학 자녀에 대한 해외 사택 무상 제공, 유학비 지원 등 법인자금 사적 유출 행위 전반으로 검증을 확대하겠다”고 말했다. 배문숙 기자。
